These Terms & Conditions govern your use of Tampa SiteGen (the "Service"). The Service is operated by Tampa SiteGen ("we", "us"), based in Tampa, Florida. By creating an account, generating a site, or purchasing a plan, you are contracting with Tampa SiteGen and you agree to these terms. If you do not agree, do not use the Service.
1. The Service
Tampa SiteGen generates single- and multi-page marketing websites for local businesses from information you supply. Generation, preview, purchase, and delivery are automated. Paid plans unlock the ability to publish your generated site at a public link and download its source code.
2. Eligibility and account
You must be at least 18 years old, or have authority to bind the business you represent. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account.
3. Acceptable use
You must not use the Service to:
- break any applicable law or regulation;
- commit fraud, send spam, or misrepresent a business you do not operate;
- infringe anyone's copyright, trademark, or other intellectual property rights;
- interfere with the security or integrity of the Service, including probing, scanning, scraping, or introducing malware.
4. Your content and generated sites
You keep ownership of the business information, text, and images you submit, and you grant us a limited licence to host and process them solely to operate the Service. You are responsible for having the rights to everything you submit and for reviewing generated copy for accuracy before publishing it. Generated output is produced automatically and may contain errors; it is not professional, legal, medical, or financial advice.
Once you have purchased a site, you receive a perpetual, non-exclusive right to use, modify, and host that site's delivered source code for your own business. We may remove or restrict content that violates these terms or a valid rights-holder complaint.
5. Our intellectual property
We retain ownership of the Service itself — the generator, templates, software, documentation, and Tampa SiteGen branding. You may not resell, redistribute, reverse engineer, or circumvent technical limits of the Service.
6. Payment, subscriptions, and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, currency, taxes, renewals, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscription plans renew automatically each billing period until cancelled. You can cancel at any time from your account's billing portal; access continues until the end of the period you have already paid for.
7. Service availability
We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, suspected fraud or security risk, or repeated policy violations. You may stop using the Service at any time. On termination you may export or download any site you have already purchased for 30 days.
9. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Nothing here excludes liability for fraud, death, or personal injury where that exclusion is not permitted.
10. Indemnity
You will indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these terms.
11. General
These terms are governed by the laws of the State of Florida, and the courts of Hillsborough County, Florida have exclusive jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms, and continued use after an update means you accept the revised version.
